1. About these terms
These terms form an agreement between Eviven and the organisation that uses Eviven ("you"). By using Eviven on behalf of an organisation, you confirm that you are allowed to accept these terms for it. Eviven is for business use only.
If your organisation has signed a separate order form or agreement with us, that document takes precedence where it differs from these terms.
2. The service
Eviven helps suppliers gather evidence for customer requirements, plan and complete work, keep notes and site records, and prepare deliverables, with AI assistance. Eviven is currently available by invitation, and features may change as we develop it.
3. Accounts and access
Access is by invitation. You sign in with a single-use code sent to your email, so keep your email account secure. You are responsible for who you invite, for the actions of your users, and for telling us promptly at privacy@eviven.com if you suspect unauthorised access.
4. Acceptable use
You must not:
- try to get around security controls, access another customer's data, or disrupt the service;
- upload material you have no right to use, or that is unlawful or harmful;
- use Eviven to build a competing product or to scrape or copy the service.
5. Your content
You keep ownership of everything you upload or create in Eviven. You give us permission to host, copy and process your content only to provide, secure and support the service for you.
You are responsible for having the right to upload your content and for any personal data in it. When we process personal data in your content, we do so as your processor under our data processing agreement and our Privacy Policy.
You can export your content at any time while your account is active.
6. AI results
AI suggestions can be incomplete or wrong. Review them before you rely on them for a compliance, safety or commercial decision, and before you send anything to a customer. Changes prepared by the Assistant only take effect after you confirm them. You remain responsible for what you submit to your customers.
7. Fees
Fees, if any, are set out in your order form or the plan you choose. We will tell you about price changes at least 30 days before they apply to you. Fees are exclusive of VAT.
8. Confidentiality
Each of us will keep the other's confidential information confidential and use it only for this agreement. This does not apply to information that is public, already known, independently developed, or that must be disclosed by law.
9. Our intellectual property
Eviven, including its software, design and documentation, belongs to us and our licensors. You may use it only as these terms allow. If you send us feedback, we may use it without obligation to you.
10. Suspension and termination
You can stop using Eviven at any time. We may suspend access if needed to protect the service or other customers, or if you seriously breach these terms, and we will tell you why unless the law prevents it.
When the agreement ends, you can export your content for 30 days. After that we delete it, as described in our Privacy Policy.
11. Warranties
We provide the service with reasonable skill and care. While Eviven is offered by invitation, it is provided as available and may change, and we do not promise that it will be uninterrupted or error-free.
12. Liability
Neither party is liable for indirect or consequential loss, such as lost profits, lost business or lost data that could have been avoided with reasonable backups. Each party's total liability under this agreement is limited to the fees you paid us in the 12 months before the claim, or SEK 10,000 if higher.
These limits do not apply to liability that cannot be limited by law, or to a breach of confidentiality, or to liability for gross negligence or wilful misconduct.
13. Changes to these terms
We may update these terms. For material changes we will tell you at least 30 days in advance. If you do not agree, you can stop using Eviven before the change takes effect.
14. Governing law and disputes
These terms are governed by Swedish law. Disputes will be settled by the courts of Sweden, with Stockholm District Court (Stockholms tingsrätt) as the court of first instance.
If these terms are translated, the English version applies.
